Terms & Conditions

Definitions
In these terms and conditions: "Company" means Miracle Leisure Products. "Buyer" means the customer who places an order and to whom the Company agrees to supply goods. "Goods" means any product or services supplied by the Company.  “Price” means the price shown on this website. 

Payment and Title
The Company reserves the right to require payment prior to delivery. 

Where the Company has agreed to supply the goods on credit, payment is due not later than 30 days from the date of the invoice. 

If payment under these conditions is not made when due an interest charge will be made on overdue payments from the original due date until payment actually takes place at the rate of 2.5% per month. 

The property in the goods shall not pass to the Buyer until paid for in full, including VAT, interest on late payment and any other sums due from the buyer to the company. 

Until such time as the legal and beneficial ownership of the Goods passes to the Buyer the Company shall be entitled at any time to require the Buyer to deliver up the Goods to the Company and if the buyer fails to do so forthwith, the Buyer hereby authorises the Company to enter upon any premises of the Buyer or any third party where the Goods are stored and to repossess the Goods. 

If the buyer makes a voluntary arrangement with its creditors or being an individual or firm becomes bankrupt or being a company becomes subject to an administration order or goes into liquidation or if a receiver is appointed over any of the buyers assets or the buyer is unable to pay its debts as they fall due then, without limiting any other remedy, the company may at its discretion suspend further deliveries or cancel contracts for the goods.

Usage
The Company will not be liable for any damage caused to persons or property by misuse of the products supplied by the company. Please read the instructions for use where appropriate.

Passing of Risk
The Goods shall be at the Buyer's risk as from delivery. 

Carraige and Delivery
Goods should be inspected upon receipt and all shortages and damages must be notified to the Company within 24 hours of receipt. 

Delivery charges on Goods supplied from the online catalogue will be as calculated by weight and delivered using the most cost-effective carrier.

Any goods supplied in accordance with the Buyer's orders but which are subsequently returned will only be credited provided the Company agree in writing in advance. 

  • All returns including packaging should be in perfect condition
  • All returns will be credited subject to a 10% handling charge
  • The cost of returning goods is at the Buyer's expens

Defective Products
All Goods are sold with manufacturer’s warranty unless specified otherwise. 

Defective goods should be returned to the Company at the Buyer's expense, along with original packaging and a copy of the original invoice. The Company may replace, repair or issue a credit note at its own discretion. 

Force Majeure
The company reserves the right to cancel, suspend or vary the operation of contract of sale if events occur which are in the nature of force majeure including (but not limited to) fire, flood, storms, strikes, lock outs, riot, hostilities or any other event outside the control of the Company. 

The company shall not be held liable for any breach of contract resulting from such an event. 

Legal Construction
These terms and conditions are subject to the law of England and Wales. These terms and conditions shall apply to all contracts for the sale of Goods by the Company to the Buyer to the exclusion of all other terms and conditions. Any variation to these Conditions shall be inapplicable unless agreed in writing by the Company.
